Fatal falling accident leads to conviction for window/door company

NEWMARKET, Ont. – Nearly two years after a worker was killed and a second injured in an incident involving a falling work station in Concord, Ont., a company that manufactures windows and doors has been fined $150,000, plus a 25 per cent victim fine surcharge, for its role in the tragedy. On March 1, 2015, two employees of FranCar 2000 Inc. were adding vent sashes to windows that they were placing on an easel, a type of free-standing work station, according to a court bulletin from the Ontario Ministry of Labour (MOL). The amount of material on the easel caused it to tip over, striking the workers and knocking them to the ground; the easel then fell onto one of the workers and caused fatal crushing injuries, the MOL stated. A subsequent investigation revealed that the back of the easel had been serving as storage for other materials at the time of the incident and that the additional weight of the windows had caused it to tip over. FranCar was later convicted in the Ontario Court of Justice in Newmarket of failing to transport, place or store material in a way that it would not collapse or fall. Justice of the Peace Karen Walker imposed the fine on Feb. 3 of this year.
